The personal data that may be collected through edithpons.art include, but are not limited to:

  • Any additional information voluntarily provided by the user through contact forms or email

As a general rule, sensitive personal data are not collected. If, in exceptional cases, such data were required, your explicit consent would be requested in accordance with applicable law.

Personal data will be used for the following primary purposes:

  1. To attend and respond to messages, inquiries or requests sent via contact forms or email.
  2. To manage requests for information regarding artworks, projects, exhibitions, collaborations or commissions.
  3. To process purchases or commissions (including payment, invoicing and shipping).
  4. To maintain a record of clients and contacts related to the artistic activity of Edith Pons.

Additionally, and only with the user’s authorization, data may be used for secondary purposes:

  1. To send informative and promotional communications about new artworks, exhibitions, events, collections, product launches or news related to the artistic career of Edith Pons, FABRICA SACRA or ADORNA.
  2. To carry out satisfaction surveys or invitations to special projects, previews or priority lists.

3. Legal basis

The processing of personal data is based on:

  • The consent of the data subject, granted when providing their data through the website or by email.  
  • The provisions of the Mexican Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations, as well as the Privacy Notice Guidelines issued by the competent authorities in Mexico.

As a general rule, personal data are not transferred to third parties other than the Controller, except in the following cases:

  • Service providers necessary to fulfill the purposes described above (for example, hosting providers, payment platforms, shipping or courier services), which will process the data solely under the Controller’s instructions.

If, in the future, additional transfers become necessary, you will be informed in accordance with applicable regulations.

5. ARCO Rights (Access, Rectification, Cancellation and Opposition) and consent withdrawal

As the data subject, you have the right to:

  • Cancel your data when you consider they are no longer necessary for the purposes indicated, are being used improperly, or when the relationship with the Controller has ended.

Means to exercise ARCO rights and withdraw consent:

  1. Full name of the data subject.
  2. Email address or other means to communicate the response.
  3. A copy of a valid official ID (such as passport, national ID or any legally accepted identification).
  4. A clear description of the data regarding which you wish to exercise your right, and the specific right you intend to exercise (Access, Rectification, Cancellation, Opposition or withdrawal of consent).

The Controller will respond within the time frames established by applicable regulations, indicating whether the request is admissible and the steps to follow.
